This data protection declaration is directed at interested parties who contact us and at our customers and cooperation partners, as well as at those persons whom we have contacted in the context of our market and opinion research projects. It applies to all processing of personal data carried out by us, both in the context of providing our services and in our online presence. We strive to protect your personal data in the best possible way and handle your data responsibly and in accordance with the current data protection regulations and legal provisions. We would like to point out that data transmission on the Internet (e.g. communication by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.


WHAT IS PERSONAL DATA

"Personal data" is information by means of which conclusions can be drawn about a specific person, such as name, address, date of birth, telephone number, etc.


WHAT DATA DO WE PROCESS

Visitor data - Web analysis - Cookies
For security reasons and to protect the transmission of confidential content, our website uses SSL or TLS encryption, which means that data transmitted to us cannot be read by third parties.

In the course of using our website, your browser data is transmitted to our server; this is necessary to ensure the stability and security of our website. The server log files may include the date and time of the call, country of origin, the IP address (shortened and no longer assignable to a specific person) and the browser data.

Our website uses Webalizer, a web analysis service provided by ALL-INKL.COM - Neue Medien Münnich. Webalizer uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. For this purpose, the usage information generated by the cookie (including your shortened IP address) is transmitted to our server and stored for usage analysis purposes, which serves to optimise the website.

Cookies cannot access, read or modify any other data on the computer. Cookies also cannot execute programs or transfer viruses to your computer. They are used to make the website as a whole more user-friendly and effective.

Your IP address is immediately anonymised during this process, so that you as a user remain anonymous to us. The information generated by the cookie is not passed on to third parties. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. The log files generated by the web analysis service are stored on a server in Germany

Contact information
If you contact us by email or via the contact form, the data you provide (name, address, telephone number, email address, etc.) will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions or the processing of any follow-up projects. You can revoke your consent at any time by sending us an informal email. The legality of the data processing procedures carried out until the revocation remains unaffected by the revocation. We delete the data accruing in this context after the storage is no longer necessary or restrict the processing if there are legal retention obligations. We do not pass on this data without your consent.

Please note that emails on the Internet are generally not sent in encrypted form. As a rule, emails are encrypted in transit, but not on the servers from which they are sent and received (unless a so-called end-to-end encryption procedure is used). Therefore, no responsibility can be assumed for the transmission path of the emails..

Client data
We collect, process and use personal data in order to be able to process the fulfilment of a contract or pre-contractual measures and in the context of communication concerning these processes. The collected customer data is deleted after completion by the order or termination of the business relationship. Statutory retention periods remain unaffected.

Study participants
Der größte Teil unserer Stichproben wird automatisch generiert (RLD- oder RDD-Verfahren - Randomized Last Digit oder Randomized Digit Dialing). Es kann außerdem vorkommen, dass wir von unseren Auftraggebern entsprechende Stichproben (Kontaktdaten) zur Verfügung gestellt bekommen. Dabei handelt es sich üblicherweise um Telefonnummern oder Email-Adressen, teilweise erweitert um Vorname, Nachname, Adresse, Ordnungsnummern, etc. Des Weiteren können für unsere Projekte Kontaktdaten zum Einsatz kommen, die wir rechtmäßig von Dritten, wie z.B. Adressverlagen, erwerben.  

All our studies are based on your voluntary participation and willingness to provide information. In the context of our studies, it may happen that you provide us with data of special categories (e.g. origin data, health data, political views, etc.).

We consistently follow the principle of pseudonymisation or anonymisation in our projects. Pseudonymisation means that immediately after the completion of a study, the contact data is separated from the survey data and only anonymised survey data is delivered to the client, which means that no further conclusions can be drawn about the person surveyed. The evaluation is exclusively carried out anonymously.

Online-Meetings
We use the Microsoft Teams tool for our online meetings. The tool can be used via the Microsoft Teams app as well as via the browser version. When using Microsoft Teams, different types of data are processed, these can be:

  • User details: e.g. display name, email address, profile picture, preferred language
  • Meeting metadata: e.g. date, time, meeting ID, phone numbers, location
  • Text, audio and video data: If you use the chat function during a meeting, the text entries you make are processed to display them in the online meeting. To enable the display of video and the playback of audio, data from the microphone or your video camera on your terminal device is processed during the meeting. You can switch off or mute the camera or microphone yourself at any time. If an online meeting is to be recorded, you will be notified in advance or asked for consent.

Personal data processed in connection with participation in online meetings will not be passed on to third parties unless it is intended to be passed on. Please note that, as with face-to-face meetings, content from online meetings is often used to communicate information with customers, prospects or third parties and is therefore intended for disclosure.

We have limited our storage location to data centres in the European Union. However, we cannot exclude the routing of data via internet servers located outside the EU. However, the data during transport via the internet is encrypted and thus secured against unauthorised access by third parties.

Social Media
We maintain online presence within social networks in order to communicate with the users active there and to offer information about our company. We would like to point out that user data may be processed outside the European Union, which could make it more difficult to enforce user rights. With regard to US providers that are certified under the Privacy Shield or have similar guarantees of secure data protection, these providers undertake to comply with EU data protection standards.

The respective detailed processing of data as well as objection options can be found in the data protection declarations of the respective operators of the platforms and networks. In the event of information requests or the assertion of data subject rights, it is most effective to contact the respective provider directly. Social media links
We have integrated social networks on our website only as a link to the corresponding services. After clicking on the integrated button, you will be redirected to the page of the respective provider. User information is only transferred to the respective provider after the forwarding.

DISCLOSURE OF DATA

External service providers
In the course of our activities, we may entrust other companies or persons with the performance of certain tasks that contribute to our services; this is done within the framework of contract processing agreements. Our external service providers are also contractually obliged to maintain confidentiality and not to use the data in any improper context or for their own purposes, or to pass it on to third parties or market it. In the context of these cooperations, it may happen that data from third countries is accessed - in such cases, however, the respective cooperation partner is fully integrated into the GDPR and in addition, corresponding order processing contracts including standard contractual clauses of the European Commission have been concluded. The operator of our online meeting tool may obtain knowledge of the above-mentioned data insofar as this is provided for in the context of the order processing agreement with Microsoft Teams.

Public authorities
If we are required by law or court order to disclose your personal data to public authorities, such as courts, law enforcement agencies, regulatory authorities, etc., we must comply with this request after careful consideration.

 
AUTOMATED DECISION MAKING

Automated decision-making or profiling in accordance with Article 22 DSGVO does not take place in our company.

 
PURPOSES OF DATA PROCESSING

We process your personal data in order to provide you with our website and to further improve and develop it, to collect usage statistics, to be able to detect, prevent and investigate any attacks on our website, to answer your enquiries or to process any resulting orders, to carry out data collection as part of our market research studies and to maintain our customer relationships.

  
LEGAL BASIS FOR PROCESSING

If you have given us consent to process your personal data for a specific purpose, this processing is based on Art. 6 (1) lit a DSGVO. If such processing is necessary to fulfil a contract with you or to carry out pre-contractual measures, this is done in accordance with Art. 6 (1) lit b DSGVO.  In some cases, e.g. for the fulfilment of tax obligations, there may be a legal obligation to process personal data, for which the legal basis is Art. 6 (1) (c). Finally, processing may be based on Art. 6 para. 1 lit f DSGVO. This is the case if the processing is carried out to protect our overriding legitimate interest, provided that your interests, fundamental rights and freedoms are not overridden. Such a legitimate interest can be assumed if you are a customer of ours. If the processing of personal data is based on Art. 6 (1) lit f DSGVO, our legitimate interest is the processing of our business activities.


DURATION OF DATA STORAGE

We adhere to the principles of data minimisation.  We therefore only store your personal data for as long as is necessary to achieve the stated purposes or as stipulated by the various retention obligations provided for by law. After the respective purpose ceases to apply or these periods expire, the corresponding data is routinely blocked or deleted in accordance with the statutory provisions. If none of the above-mentioned reasons for storage apply, data that is no longer required is deleted after 12 months as standard.


SECURITY

We have taken extensive technical and operational precautions to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Of course, we strictly adhere to data secrecy. Our security procedures are regularly reviewed and adapted to technological progress.


YOUR RIGHTS

You have the rights to free information, correction, deletion, restriction, data portability, revocation and objection. If you believe that the processing of your data violates data protection law or your data protection rights have been violated in any other way, you can contact the competent supervisory authority.
